Article 1 — Purpose and Scope
These Terms of Sale (hereinafter "Terms") govern all sales concluded on the website ohhappygames.com (hereinafter the "Website") between:

(hereinafter the "Seller")
and any consumer (hereinafter the "Customer"), being a natural person acting for purposes outside the scope of their professional activity, who places an order on the Website.
Any order implies the Customer's unreserved acceptance of these Terms, which prevail over any other conditions.
Article 2 — Products
The products offered are board games, card games, and game accessories published and/or distributed by Oh Happy Games. The essential characteristics (title, language, number of players, minimum age, duration, components) are described on each product page.
Photographs and descriptions are as accurate as possible but bind the Seller only within standard tolerances (slight variations in colour, packaging, etc.).
Products are offered subject to availability. If a product becomes unavailable after an order is placed, the Customer will be notified by email and refunded within 14 days.
Article 3 — Prices
Prices are displayed in euros (€), inclusive of all taxes (TTC), excluding delivery charges. Delivery charges are shown before order validation, in accordance with our Shipping Policy.
The Seller reserves the right to change prices at any time; products will be invoiced at the price in effect at the time of order validation.
Article 4 — Orders
4.1 Order Process
- Select products and add to cart.
- Review cart and delivery charges.
- Log in or check out as a guest.
- Choose payment method.
- Read and expressly accept these Terms (checkbox).
- Final order validation ("Pay now").
- Receive a confirmation email.
4.2 Contract Formation
The contract of sale is formed upon the Customer's receipt of the order confirmation email.
The Seller reserves the right to refuse or cancel any order in case of non-payment, prior dispute, suspected fraud, stock shortage, or obvious pricing error.
4.3 Archiving
Orders exceeding €120 are archived for 10 years in accordance with Article L213-1 of the French Consumer Code. The Customer may request a copy.
Article 5 — Payment
5.1 Accepted Payment Methods
Visa, Mastercard, American Express, PayPal, Apple Pay, Google Pay, Shop Pay.
5.2 Security
Payments are processed by Shopify Payments and/or PayPal. Bank data is encrypted (SSL/TLS) and never passes through the Seller's servers.
5.3 Payment Processing
Payment is debited at the time of order validation. If payment is declined, the order is automatically cancelled.
Article 6 — Delivery
Methods, timeframes, and rates are detailed in the Shipping Policy.
6.1 Delivery Timeframe
The Seller commits to dispatching products within a maximum of 30 days from order confirmation, in accordance with Article L216-1 of the French Consumer Code. In the event of delay beyond this period, the Customer may cancel the contract and receive a refund within 14 days.
6.2 Transfer of Risk
The risk of loss or damage transfers to the Customer upon physical possession of the goods (Article L216-4 of the French Consumer Code).
6.3 Product Not Received or Damaged
Any issue upon receipt must be reported within 7 days to contact@ohhappygames.com. See our Refund Policy.
Article 7 — Right of Withdrawal (Article L221-18 of the French Consumer Code)
The Customer has 14 days from receipt of the product to exercise their right of withdrawal without having to give any reason or pay any penalty, except for return shipping costs which remain at their expense.
If the order consists of multiple items delivered separately, the period runs from receipt of the last item.
7.1 How to Exercise
The Customer notifies their decision by email to contact@ohhappygames.com, using the standard withdrawal form appended to these Terms, or by post to Oh Happy Games SASU, 58 rue de Monceau, 75008 Paris, France.
7.2 Effects of Withdrawal
The Customer returns the product at their expense, in its original condition, within 14 days of notification. The Seller refunds the full amount paid (product + standard outbound delivery) within a maximum of 14 days, using the same payment method. The Seller may delay the refund until receipt of the product or proof of its dispatch.
7.3 Exceptions (Article L221-28)
The right of withdrawal cannot be exercised for:
- goods made to the Customer's specifications or personalised (e.g. bespoke edition, game with printed name);
- digital content on intangible media whose performance has begun with the Customer's express consent and express waiver of the right of withdrawal.
Standard board games do not fall under these exceptions: the Customer may return them even after opening the shrink wrap, provided they are in resaleable condition.
The standard withdrawal form is appended to these Terms.
Article 8 — Legal Warranties
8.1 Legal Warranty of Conformity (Articles L217-3 et seq. of the French Consumer Code)
- Duration: 2 years from delivery of the goods.
- The Customer may choose between repair or replacement. Failing that, price reduction or contract termination.
- For 24 months following delivery, the Customer is exempt from proving the existence of the defect.
8.2 Warranty Against Hidden Defects (Articles 1641 to 1649 of the French Civil Code)
- Duration: 2 years from discovery of the defect.
- The Customer may request contract termination or a price reduction.
8.3 Implementation
Contact contact@ohhappygames.com describing the defect and, if possible, attaching photos. Return and replacement shipping costs are borne by the Seller in the event of a confirmed defect.
Mandatory legal notice (Article L211-2 of the French Consumer Code):
"The consumer has a period of two years from the delivery of the goods to obtain the implementation of the legal warranty of conformity in the event of a defect of conformity. During this period, the consumer is only required to establish the existence of the defect of conformity and not the date of its appearance.
The legal warranty of conformity obliges the professional, where applicable, to provide all necessary updates to maintain the conformity of the goods.
The legal warranty of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, at no cost and without major inconvenience.
If the goods are repaired under the legal warranty of conformity, the consumer benefits from a six-month extension of the initial warranty.
If the consumer requests repair but the seller imposes replacement, the legal warranty of conformity is renewed for a period of two years from the date of replacement.
The consumer may obtain a reduction in the purchase price by keeping the goods or terminate the contract by obtaining a full refund in exchange for returning the goods if: 1° The professional refuses to repair or replace the goods; 2° Repair or replacement occurs after a period of thirty days; 3° Repair or replacement causes major inconvenience to the consumer; 4° The non-conformity persists despite the seller's unsuccessful attempt at remediation.
The consumer is also entitled to a price reduction or contract termination when the defect of conformity is so serious that it justifies immediate price reduction or contract termination. The consumer is then not required to request repair or replacement beforehand.
The consumer is not entitled to terminate the sale if the defect of conformity is minor.
Any period during which the goods are immobilised for repair or replacement suspends the remaining warranty until delivery of the restored goods.
The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code.
A seller who in bad faith obstructs the implementation of the legal warranty of conformity is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).
The consumer also benefits from the legal warranty against hidden defects under Articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This warranty entitles the consumer to a price reduction if the goods are kept or a full refund in exchange for returning the goods."
Article 9 — Liability
The Seller's liability shall not be engaged in the event of a contractual breach attributable to the Customer, force majeure (Article 1218 of the French Civil Code), or for damages resulting from improper use of the product.
The Seller's liability, if engaged, is limited to the total amount of the relevant order, except in the case of gross negligence, wilful misconduct, or personal injury.
These limitations do not apply to the Customer's rights under the legal warranties (Articles 8.1 and 8.2) or to liability for defective products (Articles 1245 et seq. of the French Civil Code).
Article 10 — Intellectual Property
All elements of the Website are protected by copyright and/or trademark law. Any unauthorised reproduction, representation, or exploitation is prohibited.
The trademark Oh Happy Games® is registered with EUIPO (No. 018646978). Game names (L'Imposteur, Gribouille Express, ChiffroPif, TurboLingo, Finde Mich, and others) are trade names of Oh Happy Games SASU.
Article 11 — Personal Data
The processing of personal data is governed by our Privacy Policy, in compliance with the GDPR and the French Data Protection Act of 6 January 1978 (as amended).
Article 12 — Disputes and Governing Law
12.1 Mediation
In accordance with Articles L612-1 et seq. of the French Consumer Code, in the event of a dispute not resolved amicably, the Customer may use a consumer mediator free of charge:

12.2 European ODR Platform
The Customer may also use the European Online Dispute Resolution platform: ec.europa.eu/consumers/odr
12.3 Jurisdiction and Governing Law
These Terms are governed by French law. Failing amicable or mediated resolution, any dispute falls under the jurisdiction of the French courts, in accordance with the rules of jurisdiction applicable to consumers (Articles R631-3 et seq. of the French Consumer Code).
Article 13 — Miscellaneous
Entirety: These Terms and the order confirmation constitute the entire agreement.
Severability: If any clause is found to be void, the remaining clauses shall remain in force.
Amendments: The Seller may amend the Terms at any time. The applicable Terms are those in effect at the date of the order.
Language: These Terms are drafted in French. In the event of translation, the French version shall prevail.
